This Privacy Policy provides you with an overview of when and what personal data FYRE Consulting AG (CHE-495.387.969) (hereinafter either “FYRE Consulting”, “us” or “we”) collects about you, how this personal data is processed and to whom it may be disclosed. You will also learn what rights you have under data protection laws with respect to your personal data processed by us and how you can exercise them. The policy applies to all personal data processed by us.

By using our website or any FYRE Consulting mobile application, you consent to the processing of your personal data and accept this Privacy Policy.

We exclude liability for the content of external links on our website or social media channels. We also disclaim responsibility for the content of any files you use with our products or services.
We reserve the right to adjust this policy from time to time. It is current as of August 2023.


1. Scope of application

This Privacy Policy generally applies whenever you contact or have contacted FYRE Consulting. In particular, this is the case when you:

– request or enter into a contractual relationship with FYRE Consulting;

– connect with us via the TeamViewer support tool;
– entered a contest, etc. (online or via email);

3. Terminology

For definitions of terms relevant under data protection law, such as “personal data”, “processing”, etc., we refer to the relevant data protection laws, in particular the Swiss Data Protection Act (Federal Act on Data Protection (FADP); SR 235.1) and the Data Protection Ordinance (Ordinance to the Federal Act on Data Protection (FADP); SR 235.11) and, as far as applicable, the General Data Protection Regulation of the European Union (GDPR).

4. Basis of the collection and processing of personal data

Your trust in us to protect your personal data and thus your personality is important to us. We are therefore guided by the following principles:

We transparently disclose to you what personal data we process for what purpose, how long we keep it and how we protect it. We only process personal data that we have lawfully received and – in cases where we need to – have a legal basis to process.

A legal basis may be (i) the initiation or fulfillment of a contract, (ii) your consent, (iii) a law or (iv) a public interest that allows us to process it, or (v) a legitimate interest on our part (e.g., maintaining the functionality of our IT systems, documenting business contacts, marketing our own and third-party products and services, quality assurance).

5. Purpose of processing

We collect and use personal data to the extent necessary to provide a functional website and our content and to process your order or to provide further services, to respond to contact requests, range measurement and marketing, for any security measures, for the security of persons, buildings and objects of us, and to process applications.

5.1 Visitors to a website of FYRE Consulting AG

When visiting the website of FYRE Consulting, the following information is stored by each visitor:
– IP address used;
– Browser incl. version;
– Operating system incl. version; and
– if available, the domain that led to www.fyre-consulting.ch (search engine, banner, etc.).

FYRE Consulting may use the visitor’s IP address to ensure compliance with this Privacy Policy or to ensure the security of FYRE Consulting services, our homepage or other users.

5.2 Interested parties and customers

If you would like to purchase products or services from FYRE Consulting AG, we collect the following personal data from you in particular when you place an order and/or execute a contract: Salutation, first name, last name, company name, address and house number, postal code and place of residence or work, e-mail address, telephone number (landline and mobile number) and customer-specific comments.

We process this personal data for the following purposes:
– for the or a (potential) conclusion of a contract;
– for the fulfillment and execution of contractual and legal obligations;
– for ensuring the services and their quality, including the optimization and personalization of services;
– for the administration and maintenance of the customer relationship (e.g. change of address);
– for the security of operations or infrastructure (e.g. prevention of fraud);
– for billing purposes.

In order to be able to provide you with further offers on FYRE services and corresponding optimizations, we process personal data:
– for market research purposes, in particular for the needs-based and customer-oriented design and development of products and services of FYRE Consulting as well as for the preparation of customized offers;
– for marketing purposes, i.e. we will send you advertising by e-mail, mail or telephone about other similar products and services of FYRE Consulting.

You have the option to object to this processing at any time.

5.3 Newsletters and promotional emails

If you have consented to us using your email address for newsletter or promotional purposes, we will occasionally send you newsletters or customized advertisements to make you aware of other similar offers and services or news about FYRE Consulting AG.

By subscribing to the newsletter, you accept the privacy policy of our provider Mailchimp.

You can object to this processing of your e-mail address at any time in the respective newsletter itself by unsubscribing via the link at the end of the newsletter or, with regard to advertising e-mails, via the contact form specified in section 2.1.

6. Transmission to third parties

Personal data is only passed on to third parties in the following selected cases:
– if the transfer is necessary for the conclusion or fulfillment of a contract concluded with you;
– if you have expressly given your consent to this; or
– if we are legally obliged to pass on the data.

Your personal data may also be disclosed to third parties outside FYRE Consulting, such as license partners, who, as contractual partners of FYRE Consulting, perform technical or organizational services that we need to fulfill the above purposes or general business activities.

This may be, for example, a supplier or contractual partner of hardware, software, licenses, domains, etc., or a hosting partner.

We may disclose personal data to third parties for the purpose of a credit check, debt collection, factoring, collateralization of financing or assignment of claims arising from the customer contracts in the interest of FYRE Consulting. The data recipient processes the transmitted data on its own responsibility under the applicable data protection regulations. We would like to point out that payment histories, in particular undisputed claims and claims unpaid after the due date, as well as debt collection information and address data, if applicable, may be transmitted to contractual partners of FYRE Consulting AG, for legitimate use as commercial information.
The above-mentioned contractual partners of FYRE Consulting AG are mainly located in Switzerland and in the European Union. If a contractual partner is located in a country whose data protection laws do not guarantee protection of personal data comparable to that in Switzerland, we conclude contracts on the basis of the standard contractual clauses for data transfer to third countries in accordance with Art. 46 of the EU General Data Protection Regulation (GDPR).

We reserve the right to disclose personal data on the basis of a sovereign decision or by law, e.g. to a law enforcement agency, for the purpose of prosecuting and uncovering unlawful activities or to the ÜPF service.

7. Technologies used

7.1 Server log file

Page views are recorded in a log file of the web server, according to the privacy policy of the web hosting provider Hostpoint AG.

This record contains the following information:
– the IP address from which the web page is called up
– which subpage was called and whether the call was successful
– the size of the file transferred
– the date and time of the page view
– if the page is called up via a link, the original page is also recorded (HTTP referrer), provided your browser sends this information along with it
– the web browser used to call up the page and the operating system used (user agent)
– as well as indirectly the language transmitted by the web browser.

The logging of web server accesses is done in order to detect and analyze attacks and problems on our website, but not for advertising purposes.

7.2 Cookies

When you visit our website, a temporary cookie (session cookie) is set. This is used for technical functions of the website.

A cookie is a simple string of characters that is stored in the web browser. In the case of a session cookie, it is only stored until the web browser is closed.

Other cookies are also set when the page is called up. This is done by Google Analytics (see section 7.7).

In general, the setting of cookies can be disabled in the web browser and already existing cookies can be deleted there.

7.3 Order or other contact forms

When using our forms on our website, data transmission is voluntary.

Entries made in the web form are stored by us in case of follow-up questions or a contract conclusion.

7.4 Application by e-mail or mail

If you apply for a position at FYRE Consulting, the personal data you provide for this purpose will be stored and, if necessary, processed on systems of our software partner.

7.5 TeamViewer

If you contact us with a support request using the TeamViewer software, we use the services of TeamViewer Germany GmbH, https://www.teamviewer.com/en-us/.

7.6 Google Chat and Google Meet

If you contact us via Google Chat or Google Meet, you use the services of Google and accept their privacy policy. More information is available at https://policies.google.com/privacy.

7.7 Google Analytics

We use Google Analytics for user analysis in order to continuously optimize the design of our offers and our website.

You have the option of objecting to the collection of data generated by Google Analytics and related to the use of this website, as well as to the processing of this data by Google, and to prevent such processing. To do this, you must download and install a browser add-on under the link https://tools.google.com/dlpage/gaoptout.

You can set the so-called Do-Not-Track header in the web browser. This will then be transmitted each time you visit the website. If you have set the Do-Not-Track header, we will deactivate the integration of Google Analytics on our website; this means that no user analysis will take place.

8. Data security

Our websites can only be accessed via https://, i.e. TLS encrypted. This ensures secure transmission of the data you enter.

We operate secure data networks that comply with the applicable technical standards. Appropriate technical and organizational precautions are taken to protect your data from loss, destruction, falsification, manipulation or unauthorized access.

Although FYRE Consulting uses all necessary means to prevent the disclosure of data due to errors in data transmission or unauthorized access by third parties, FYRE Consulting cannot accept any liability for such undesirable events.

9. Duration of data storage

We store personal data as long as it is necessary or appears necessary for the fulfillment of the purpose. A storage period that deviates from this may result from legal evidence and obligations to maintain records, which are regulated, among other things, in the Swiss Code of Obligations (SR 220), the Business Records Ordinance (GeBüV SR 221.431), the Telecommunications Act (FMG; SR 784.10) or the BÜPF (SR 780.1), as well as for reasons of preserving evidence or avoiding a statute of limitations for legal claims.

You have the right at any time to refuse to give your consent or to revoke consent that has already been given.

In addition, you have the option to complain to the data protection supervisory authority.
